If, during the bid evaluation period, CMS finds that a supplier does not meet all applicable state and territory licensure requirements for the nationwide remote item delivery competitive bidding area, the supplier will not be eligible to be awarded a contract under the DMEPOS CBP. Similarly, if, after awarding a contract, CMS determines that a supplier does not meet all applicable state and territory licensure requirements, CMS may terminate the supplier’s contract or take additional enforcement action, as appropriate. It is your responsibility as a bidder to verify all required licenses before submitting your bid, obtain any required licenses prior to the applicable deadline, ensure licenses are current and in good standing in the Provider Enrollment, Chain, and Ownership System (PECOS) by the close of the bid window, and understand any exemptions that may apply to your situation.
